Family of Oscar Grant III, 22, alleges BART Police Officer Johannes Mehserle used excessive force by fatally shooting Grant on January 1, 2009 while Grant lay face-down and restrained on the Fruitvale BART station platform in Oakland. Mehserle claimed he intended to draw his taser but drew his firearm instead. Mehserle was convicted of involuntary manslaughter. Claims of excessive force, unreasonable seizure, and civil rights violations under 42 U.S.C. § 1983.
